DMCA NOTICE & COPYRIGHT POLICY

Statement of Respect. The works on this Site—including text, images, design, and dossiers—are original creations of Calder N. Halden and are protected under U.S. and international copyright law. We respect others’ rights and expect the same in return.

1) Designated Agent & Scope

This policy applies to https://echofyre.com and related subpages. Although EchoFyre does not host user-generated content, we respond to legitimate DMCA notices regarding any material hosted here.

Fair Use: Some uses of copyrighted material are permitted under U.S. law (e.g., criticism, commentary, scholarship). If you believe a use is fair, explain that in your notice or counter-notice.

2) Submitting a Proper DMCA Notice

If you believe material on this Site infringes your copyright, send a notice to our Designated Agent containing all of the following:

  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material claimed to be infringing (URL(s) or specific description sufficient to locate it).
  • Your name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
  • Your physical or electronic signature.

Note: Incomplete notices may not be processed. Knowingly sending false claims may expose you to liability under 17 U.S.C. § 512(f).

3) Our Response to Notices

Upon receiving a valid notice, we will:

  • Review the claim.
  • Remove or disable access to the allegedly infringing material.
  • Notify the affected party (if applicable).
  • Where appropriate, provide an opportunity to submit a counter-notification.

Removal or disabling may be temporary pending resolution of the dispute.

4) Counter-Notification

If material was removed due to a DMCA notice and you believe it is not infringing, you may submit a counter-notification to our Designated Agent. Your counter-notification must include:

  • Identification of the material that was removed and its location before removal.
  • A statement, under penalty of perjury, that you believe the material was removed or disabled as a result of mistake or misidentification.
  • Your name, mailing address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the U.S. District Court for the Western District of Tennessee (or, if outside the U.S., any appropriate U.S. federal court) and that you will accept service of process from the person who submitted the original notice or their agent.
  • Your physical or electronic signature.

We may restore the material if the original complainant does not file a legal action within ten (10) business days after we forward the counter-notification.

5) Protection of EchoFyre’s Works

All original works on this Site—including text, imagery, HTML/CSS, dossiers, and derivative materials—are protected by U.S. copyright (Title 17, U.S.C.). Unauthorized activities—such as reposting, uploading manuscripts or codex entries to file-sharing services, or selling/reselling without license—may result in:

  • DMCA takedown notices to hosts and platforms,
  • de-indexing requests to search engines, and
  • civil legal action seeking remedies including statutory damages up to $150,000 per willful infringement and recovery of attorneys’ fees (17 U.S.C. § 504(c)).

6) Repeat Infringers

Consistent with the DMCA, EchoFyre will terminate or block access for repeat infringers where applicable.

7) Changes to this Policy

We may update this Policy from time to time. Updates will be posted at https://echofyre.com/dmca with a new effective date. Continued access after posting constitutes acceptance of the revised Policy.
