This Policy explains what we collect, why, how long we keep it, how we protect it, and how you can exercise your rights.

1. Information We Collect

1.1. Age-Affirmation Cookie

Name: archiveAccess_v2 (value: adult)

Purpose: Remember that you affirmed “I am 18+” so we don’t prompt you repeatedly.

Data Stored: The cookie value itself. No personal details are stored in the cookie.

Retention: The cookie expires after approximately fourteen (14) days. Your browser may clear it sooner if configured to do so.

1.2. Contact & Subscription Data

If you subscribe to the newsletter or contact us, we collect the email address and name you provide. We may store this data with an email service provider (e.g., Mailchimp, ConvertKit, or a similar vendor). That provider’s privacy policy applies in addition to this one.

Retention: Until you unsubscribe or request deletion. Our emails include an unsubscribe link; you may also email privacy@echofyre.com to be removed.

1.3. Usage & Server Logs

Our hosting provider logs standard connection data (e.g., IP address, date/time, page requested, user agent). We use logs for troubleshooting, security, and abuse prevention.

Retention: Up to ninety (90) days unless longer retention is legally required.

1.4. Third-Party Services

If we enable third-party services (e.g., analytics, embedded media, payment processors), those services may collect their own data under their policies. We identify material third-party processors in this Policy when active and will update this Policy if our stack changes materially.

2. How We Use Information

2.1. Operate and maintain the Site, including remembering age-affirmation.

2.2. Respond to correspondence and fulfill subscription requests, including sending newsletters you opt into.

2.3. Detect and respond to abuse, security incidents, and violations of the Terms of Use.

2.4. Comply with legal obligations (e.g., responding to lawful requests, court orders, and DMCA notices).

3. Legal Bases (where applicable)

3.1. EEA/UK: (a) consent for cookies where required; (b) our legitimate interests in securing and operating the Site (e.g., logs, access control); (c) contract where you subscribe or purchase.

3.2. California: See the California Privacy Notice below for CCPA/CPRA rights. We do not sell or share personal information as those terms are defined by the CPRA.

4. Sharing & Disclosure

4.1. We do not sell personal data. We disclose personal data only to: (a) service providers acting on our behalf (e.g., email, hosting, payments); (b) comply with legal obligations; (c) respond to DMCA or other rights claims; (d) protect the rights, property, or safety of EchoFyre and users.

4.2. We require service providers to safeguard data consistent with this Policy.

5. Data Retention & Deletion

5.1. Cookie: The age-affirmation cookie expires after ~14 days.

5.2. Server logs: Retained up to 90 days for security/abuse review.

5.3. Subscriber emails: Retained until you unsubscribe or request deletion.

5.4. Deletion Requests: Email privacy@echofyre.com with subject “Delete My Data.” We will verify requests reasonably and complete deletion within thirty (30) days where feasible, except where retention is required by law.

6. Security

6.1. We use industry-standard measures (HTTPS/TLS, secure hosting, limited access) to protect data. No system is perfect; we will notify affected users and authorities as required by law in the event of a breach.

7. Children & Minors

7.1. The Site is not intended for children under 18. We do not knowingly collect personal information from minors. If you believe we have inadvertently collected a minor’s data, contact us and we will take prompt steps to delete it.

8. Cookies & Controls

8.1. Necessary: archiveAccess_v2=adult — required to remember your age affirmation.

8.2. Optional: If we enable analytics or embeds, third-party cookies may be used; refer to the vendor’s policy.

8.3. Managing Cookies: Most browsers let you refuse or delete cookies. Doing so may require you to re-confirm age on each visit.

9. Your Rights

9.1. Access — request a copy of your personal data we hold.

9.2. Correction — request corrections to inaccurate data.

9.3. Deletion — request deletion as described above.

9.4. Object/Restrict — where applicable, ask us to stop certain processing.

9.5. Portability — where applicable, request a structured export.

9.6. To exercise rights, email privacy@echofyre.com. We typically respond within thirty (30) days.

10. International Transfers

10.1. The Site is hosted in the United States. If you are outside the U.S., by using the Site you consent to the transfer of your data to the United States and other jurisdictions.

11. California Privacy Notice (CCPA/CPRA)

11.1. California residents have the right to know the categories of personal information collected, the categories of sources, purposes, and the categories of third parties with whom information is shared, and the right to request deletion or opt out of sale or sharing. We do not sell or share personal information as defined by the CPRA. To submit a request, email privacy@echofyre.com. We will verify requests as required.

12. Changes to This Policy

12.1. We may update this Policy. The updated policy will be posted at https://echofyre.com/privacy.html with a new effective date. Continued access after posting constitutes acceptance.
